Full Rules (the “Rules”):

NO PURCHASE NECESSARY TO ENTER OR WIN.

1. ELIGIBILITY:

The 2024 Q4 Mastercard Everyday Spend Contest (the “Contest”) begins November 1, 2024 at 9:00:01 a.m. Eastern Time ("ET") and ends at 11:59:59 p.m. ET on December 31, 2024 (the “Contest Period") and is open to holders, as of October 31, 2024, of an “Eligible Mastercard Card” (as hereinafter defined), who are residents of Canada and are of the age of majority or older in their province/territory of residence at the time of entry. For purposes of the Contest, an “Eligible Mastercard Card” is a personal debit, credit, general purpose reloadable prepaid or small business Mastercard card issued by a participating financial institution and which such issuing financial institution, in its sole discretion, has determined and communicated (via email or advertising) is eligible for participation in the Contest. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Mastercard Canada ULC (the “Sponsor”), participating Mastercard issuing financial institutions (each, a “Participating FI”), their respective parent companies, related companies, affiliates, distributors and subsidiaries and advertising/promotion agencies, including Armstrong Partnership LP (the “Contest Administrator”) (collectively, the “Contest Parties”), are not eligible to participate in the Contest. This Contest is subject to all applicable federal, provincial, and local laws and regulations.

The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification.

2. HOW TO ENTER:

  1. In order to enter the Contest, eligible holders of an Eligible Mastercard Card must first register for the Contest, during the Contest Period, through the Contest entry form provided by the Participating FI who issued such eligible holder’s Eligible Mastercard Card (see also Rule 7);
  2. Once an eligible entrant has registered for the Contest as outlined in Rule 2 (i) above, the entrant can obtain Contest entries in one or both of the following ways:
    1. An eligible registered entrant will automatically receive one (1) Contest entry for each eligible purchase transaction (“Eligible Transaction”) made using their Eligible Mastercard Card during the Contest Period, provided the Eligible Transaction is posted to their account no later than January 2, 2025. Purchase transactions involving account adjustment transactions/returns and international transactions, late payment fees, over-limit or over-draft transactions or fees, return cheque fees, cheque re-order fees, ATM transactions or fees, cash advances, monthly/annual fees, balance transfers and/or other fees assessed on your account are not eligible for automatic Contest entry. Entries from corporate cards, international cards, unauthorized card use or those made with lost, stolen or fraudulent cards are void. Only purchase transactions made with an Eligible Mastercard Card for an account that is in good standing (at both time of entry and winner selection) and issued by a Participating FI in Canada to an identifiable cardholder and that are processed and submitted through Sponsor’s Canadian transaction processing system during the Contest Period are eligible for automatic entry; or
    2. No Purchase Necessary: To obtain a Contest entry without purchase, eligible registered entrants may hand print their full name as it appears on their Eligible Mastercard Card, their complete mailing address (including postal code), email address, telephone number and age on a plain piece of paper and mail it in a sealed postage prepaid envelope to: 2024 Q4 Mastercard Everyday Spend Contest, No Purchase Entry, 4211 Yonge Street, Suite 601, Toronto, Ontario M2P 2A9. Each mail-in entry will result in one (1) entry in the random prize draw. Enter as often as you wish by mail, but each entry must be: (a) mailed in a separate sealed envelope with sufficient postage; and (b) postmarked no later than December 31, 2024, and received no later than January 2, 2025. Incomplete and/or illegible entries are ineligible. No photocopied, computer-generated facsimiles, mechanically reproduced, bulk or mass entries permitted.

There is no limit to the number of entries. All entries, regardless of the method of entry, become the property of Sponsor and will not be acknowledged or returned. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries, Eligible Transactions and/or entrants. Your registration for the Contest constitutes your consent to participate in this Contest in accordance with these Rules and your consent for the applicable Participating FI to obtain (and to share with the Sponsor and the Contest Administrator) your name, email address and other personal information relevant to this Contest, only for the purpose of administering this Contest. Sponsor and/or its agents or representatives (including the Contest Administrator) will receive such personal information about you from the applicable Participating FI only in the event that you are a selected entrant. If you are a selected entrant, Sponsor and/or its agents or representatives (including the Contest Administrator) will receive the information necessary to contact you from the applicable Participating FI. The Released Parties (defined below) are not responsible for lost, incomplete, illegible, late, misdirected, stolen, postage-due, or mutilated entries or mail; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines or telephone systems; interrupted or unavailable cable or satellite systems; errors in these Rules, in any Contest-related advertisements or other materials; failures of electronic equipment, computer hardware or software, or inaccurate entry information, whether caused by equipment, programming used in this Contest, human processing error, or otherwise. 

If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use multiple names, identities, email addresses, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then such person may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.

MOBILE REGISTRATION:  Message and data rates (and perhaps other charges) may apply to use of mobile device for registration for Contest entry. You may be charged by your wireless carrier if participating in the Contest via mobile device. It is therefore recommended that you consult your wireless carrier’s pricing plan BEFORE participating in the Contest via mobile device. Not all mobile devices offer wireless Internet access and wireless Internet access may not be available in all areas.

All entries (and Eligible Transactions) are subject to verification at any time. The Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor — including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Sponsor’s official clock.

3. PRIZES:

There is one (1) grand prize (“Grand Prize”) available to be won, consisting of $5,000 in Mastercard prepaid cards. Value of the Grand Prize is $5,000 CAD.

There are five (5) secondary prizes (“Secondary Prizes”) available to be won, each consisting of $500 in Mastercard prepaid cards. Value of each Secondary Prize is $500 CAD.

The Grand Prize and Secondary Prizes (collectively the “Prizes” and individually a “Prize” or “prize”) must be accepted as awarded, are not transferable, assignable or convertible to cash, and there can be no substitutions (except as may otherwise be specifically permitted by Sponsor in its sole and absolute discretion). Sponsor reserves the right at any time to substitute a Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award. Mastercard prepaid cards may be subject to additional terms and conditions which shall be provided to the winner(s) upon delivery of the Prizes.

Limit of one (1) prize per person.

4. WINNER SELECTION AND NOTIFICATION:

On Jan 6, 2025 (the “Draw Date”), at approximately 2:00 p.m. ET at 4211 Yonge Street, Suite 601, Toronto, Ontario M2P 2A9, one (1) eligible entrant will be selected by random draw by the Administrator as the potential Grand Prize winner, and five (5) eligible entrants will be selected as the potential Secondary Prize winners. Odds of winning depend on the number of eligible entries received in accordance with these Rules. The Sponsor will provide the Contest Administrator with the contact information for each selected entrant.

Subject to compliance with these Rules, in the event that a potential winner is selected via an Eligible Mastercard Card transaction, the prize will be awarded to the eligible individual named on the card that is used to transact the winning entry (as determined by the Participating FI’s account records and subject to such Participating FI’s timely identification of the individual named on the applicable card). In the event that a Mastercard small business card winning account is selected, if awarding of a prize is in conflict with the applicable business’s written policy or not feasible after Sponsor’s good faith effort to obtain the eligible cardholder contact information from the applicable Participating FI, prize will be forfeited and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries received in accordance with these Rules. In the event that a potential winner is selected via a mail-in entry, the prize will be awarded (subject to verification of eligibility) to the eligible individual whose full name appears on the mail-in entry.

The Sponsor and/or the Contest Administrator will make a minimum of three (3) attempts to contact the selected entrants by mail, telephone or email within forty-five (45) business days of the Draw Date. If a selected entrant cannot be contacted within forty-five (45) business days of the Draw Date, or there is a return of any notification as undeliverable; then he/she will be disqualified (and forfeit all rights to his/her prize) and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new selected entrant). For greater certainty and the avoidance of any doubt, the Sponsor does not have the obligation to select an alternate eligible winner. In any event, no potential winner will be selected after March 17, 2025.

5. WINNER CONFIRMATION:

Prior to being declared a confirmed winner of a Prize, the potential winner will be required to: (i) correctly answer a time-limited, mathematical, skill-testing question (without electronic, mechanical or other assistance); and (ii) sign and submit the Sponsor’s declaration and release, which (among other things): (a) confirms compliance with these Rules; (b) acknowledges acceptance of the prize as awarded; and (c) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize. If a potential winner: (a) fails to correctly answer the skill-testing question; (b) fails to submit the properly executed Contest documents; and/or (c) cannot accept the applicable prize for any reason, then he/she will be disqualified (and will forfeit all rights to the prize) and an alternate winner may be selected.

Winners are responsible for obtaining professional tax advice and are responsible for any tax obligations arising from the Prizes.

6. GENERAL:

The decisions of the Sponsor (and/or the Contest Administrator, as applicable) with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Eligible Transactions and/or entrants. The Released Parties are not responsible for: (i) any error, omission, interruption, defect or delay in transmission or communication; (ii) technical or mechanical malfunctions; (iii) errors in these Rules, or in any Contest-related advertisements or other materials; and (iv) failures of electronic equipment, computer hardware or software, or inaccurate capture of information, whether caused by equipment, programming used in this Contest, human processing error, or otherwise.

Sponsor reserves the right, at its sole discretion to disqualify any entry, to modify, terminate, or suspend this Contest (or amend these Rules) should a virus, bug, non-authorized human intervention, action of entrant(s), or other cause corrupt or impair the administration, security, fairness, or proper play of the Contest, and, if the Contest is modified, terminated, or suspended, select at random a winner from those eligible, non-suspect entries received prior to the event requiring such modification, termination or suspension. The Sponsor reserves the right to cancel or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. 

By participating in this Contest, each entrant: (i) agrees to be legally bound by these Rules; (ii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action; and (iii) releases the Released Parties from any and all liability in connection with this Contest and his/her participation therein.

By participating, entrants agree that the Released Parties shall have no liability and will be held harmless for any liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a Prize or participation in this Contest.

Except where prohibited by law, acceptance of a Prize constitutes winner’s consent to Sponsor’s and its agents’ use of the winner’s name, likeness, photograph, voice, opinions and/or city/province of residence for advertising and promotional purposes in any media, worldwide, without payment or consideration. You may be required to sign a document confirming your consent to this effect. Personal information of the Prize winners may be stored on servers located in the United States and therefore subject to the laws of the U.S. and/or other jurisdictions.

All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates and/or the applicable Participating FI. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to any point of sale, television, print or online advertising or the French version of these Rules; the terms and conditions of these English Rules shall prevail, govern and control.

7. PRIVACY:

By entering this Contest, each entrant expressly consents to the applicable Participating FI and its agents and/or representatives collecting, storing, sharing (including for greater certainty, with the Sponsor and the Contest Administrator) and using the entrant’s personal information only for the purpose of administering the Contest and in accordance with the privacy policy of the applicable Participating FI and, only to the extent applicable, the Sponsor’s privacy policy https://www.mastercard.ca/en-ca/vision/corp-responsibility/commitment-to-privacy/global-privacy-policy.html. This consent does not limit any other consent(s) that an individual may provide a Participating FI or others in relation to the collection, use and/or disclosure of the entrant’s personal information for other purposes. Holders of Eligible Mastercard Cards may receive emails or other marketing communications from the Participating FI’s who issued the applicable Eligible Mastercard Cards (or their affiliated retailers or other entities) advertising the Contest and providing details of, and/or links to, the Contest registration page for such Participating FI, for Contest entry purposes. Neither the Sponsor nor the Contest Administrator is responsible for, nor assumes any liability of any kind or nature whatsoever for, the contents of any such emails or marketing communications from such Participating FI’s (or their affiliated entities) or for any collection, sharing or other use or disclosure by such Participating FI’s (or their affiliated entities) of any personal information of entrants for any purpose.

Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Mastercard Canada ULC (the “Sponsor”), participating Mastercard issuing financial institutions (“FIs”), their respective parent companies, related companies, affiliates, distributors and subsidiaries and advertising/promotion agencies, including Armstrong Partnership LP (the “Contest Administrator”)(collectively, the “Contest Parties”), are not eligible to participate in the Contest. Sponsor reserves the right, at its sole discretion to disqualify any entry, to modify, terminate, or suspend this Contest (or amend these Rules) should a virus, bug, non-authorized human intervention, action of entrant(s), or other cause corrupt or impair the administration, security, fairness, or proper play of the Contest, and, if the Contest is modified, terminated, or suspended, select at random a winner from those eligible, non-suspect entries received prior to the event requiring such modification, termination or suspension. The Sponsor reserves the right to cancel or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. By participating in this Contest, each entrant: (i) agrees to be legally bound by these Rules; (ii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action; and (iii) releases the Released Parties from any and all liability in connection with this Contest and his/her participation therein.

By participating, entrants agree that the Released Parties shall have no liability and will be held harmless for any liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a Prize or participation in this Contest.

You may be required to sign a document confirming your consent to this effect. Personal information of the Prize winners may be stored on servers located in the United States and therefore subject to the laws of the U.S. and/or other jurisdictions.

All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates and/or the participating Mastercard issuing financial institutions. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to any point of sale, television, print or online advertising or the French version of these Rules; the terms and conditions of these English Rules shall prevail, govern and control.

The 2024 Mastercard Everyday Spend Contest (the “Contest”) is open to holders, as of January 31, 2024, of an “Eligible Mastercard Card” (as hereinafter defined), who are residents of Canada and are of the age of majority or older in their province/territory of residence at the time of entry. For purposes of the Contest, an “Eligible Mastercard Card” is a personal debit, credit, general purpose reloadable prepaid or small business Mastercard card issued by a participating issuer and which such issuer, in its sole discretion, has determined and communicated (via email or advertising) is eligible for participation in the Contest. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Mastercard Canada ULC (the “Sponsor”), participating Mastercard issuing financial institutions (“FIs”), their respective parent companies, related companies, affiliates, distributors and subsidiaries and advertising/promotion agencies, including Armstrong Partnership LP (the “Contest Administrator”)(collectively, the “Contest Parties”), are not eligible to participate in the Contest. This Contest is subject to all applicable federal, provincial, and local laws and regulations.

The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification.

2. HOW TO ENTER:

  1. Cardholders of an Eligible Mastercard Card will automatically receive one (1) Contest entry for each eligible purchase transaction (“Eligible Transaction”) made using their Eligible Mastercard Card between February 1, 2024, at 9:00:01 a.m. Eastern Time (“ET”) and April 30, 2024, at 11:59:59 p.m. ET (the “Contest Period”), provided the Eligible Transaction is posted to their account no later than May 2, 2024. Purchase transactions involving account adjustment transactions/returns and international transactions, late payment fees, over-limit or over-draft transactions or fees, return cheque fees, cheque re-order fees, ATM transactions or fees, cash advances, monthly/annual fees, balance transfers and/or other fees assessed on your account are not eligible for automatic Contest entry. Entries from corporate cards, international cards, unauthorized card use or those made with lost, stolen or fraudulent cards are void. Only purchase transactions made with an Eligible Mastercard Card for an account that is in good standing (at both time of entry and winner selection) and issued by a participating Mastercard issuing financial institution in Canada to an identifiable cardholder and that are processed and submitted through Sponsor’s Canadian transaction processing system during the Contest Period are eligible for automatic entry.

    Opt Out: If a holder of an Eligible Card does not wish to be entered into this Contest, they may opt out from participation by May 2, 2024, by calling 1-866-225-8565.

  2. No Purchase Necessary: To enter without purchase, hand print your full name as it appears on your Eligible Mastercard Card, your complete mailing address (including postal code), email address, telephone number and age on a plain piece of paper and mail it in a sealed postage prepaid envelope to: Mastercard Everyday Spend Contest, No Purchase Entry, 4211 Yonge Street, Suite 601, Toronto, Ontario M2P 2A9. Each mail-in entry will result in one (1) entry in the random prize draw. Enter as often as you wish by mail, but each entry must be: (a) mailed in a separate sealed envelope with sufficient postage; and (b) postmarked no later than April 30, 2024, and received no later than May 5, 2024. Incomplete and/or illegible entries are ineligible. No photocopied, computer-generated facsimiles, mechanically reproduced, bulk or mass entries permitted.

There is no limit to the number of entries. All entries, regardless of the method of entry, become the property of Sponsor and will not be acknowledged or returned. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries, Eligible Transactions and/or entrants. Your use of your Eligible Mastercard Card to make a purchase and/or your submission of a mail-in entry constitutes your consent to participate in this Contest and your consent for Sponsor to obtain (and to deliver to the Contest Administrator) your name, address, email address and other information only for the purpose of administering this Contest. Sponsor and/or its agents or representatives will obtain personally identifiable information about you only in the event that you are a selected entrant. If you are a selected entrant, Sponsor and/or its agents or representatives will obtain the information necessary to contact you from your financial institution. The Released Parties (defined below) are not responsible for lost, incomplete, illegible, late, misdirected, stolen, postage-due, or mutilated entries or mail; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines or telephone systems; interrupted or unavailable cable or satellite systems; errors in these Rules, in any Contest-related advertisements or other materials; failures of electronic equipment, computer hardware or software, or inaccurate entry information, whether caused by equipment, programming used in this Contest, human processing error, or otherwise. 

All entries (and Eligible Transactions) are subject to verification at any time. The Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor — including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Sponsor’s official clock.

3. PRIZES:

There is one (1) grand prize (“Grand Prize”) available to be won, consisting of $5,000 in Mastercard prepaid cards. Value of the Grand Prize is $5,000 CAD.

There are five (5) secondary prizes (“Secondary Prizes”) available to be won, each consisting of $500 in Mastercard prepaid cards. Value of each Secondary Prize is $500 CAD.

The Grand Prize and Secondary Prizes (collectively the “Prizes”) must be accepted as awarded, are not transferable, assignable or convertible to cash, and there can be no substitutions (except as may otherwise be specifically permitted by Sponsor in its sole and absolute discretion). Sponsor reserves the right at any time to substitute a Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award. Mastercard prepaid cards may be subject to additional terms and conditions which shall be provided to the winner(s) upon delivery of the Prizes.

Limit of one (1) prize per person.

4. WINNER SELECTION AND NOTIFICATION:

On May 15, 2024 (the “Draw Date”), at approximately 2:00 p.m. ET at 4211 Yonge Street, Suite 601, Toronto, Ontario M2P 2A9, one (1) eligible entrant will be selected by random draw by the Contest Administrator as the potential Grand Prize winner, and five (5) eligible entrants will be selected as the potential Secondary Prize winners. Odds of winning depend on the number of eligible entries received in accordance with these Rules.

In the event that a potential winner is selected via an Eligible Mastercard Card transaction, prize will be awarded to the primary account holder (as determined by the Mastercard FI’s account records and subject to said FI’s timely identification of the account holder) named on the account accessed by the Eligible Mastercard Card used to make the entry. In the event that a Mastercard small business card winning account is selected, the prize will be awarded to the individual named on the card that is used to transact the winning entry (as determined by the Mastercard FI’s account records and subject to said FI’s timely identification of the individual named on the applicable card). If awarding of a prize is in conflict with the business’s written policy or not feasible after Sponsor’s good faith effort to obtain account holder contact information from the applicable Mastercard FI, prize will be forfeited and an alternate winner may be selected.

The Sponsor and/or the Contest Administrator will make a minimum of three (3) attempts to contact the selected entrants by mail, telephone or email within thirty (30) business days of the Draw Date. If a selected entrant cannot be contacted within thirty (30) business days of the Draw Date, or there is a return of any notification as undeliverable; then he/she will be disqualified (and forfeit all rights to his/her prize) and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new selected entrant). For greater certainty and the avoidance of any doubt, the Sponsor does not have the obligation to select an alternate eligible winner. In any event, no potential winner will be selected after June 15, 2024.

5. WINNER CONFIRMATION:

Prior to being declared a confirmed winner of a Prize, the potential winner will be required to: (i) correctly answer a time-limited, mathematical, skill-testing question (without electronic, mechanical or other assistance); and (ii) sign and submit the Sponsor’s declaration and release, which (among other things): (a) confirms compliance with these Rules; (b) acknowledges acceptance of the prize as awarded; and (c) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize. If a potential winner: (a) fails to correctly answer the skill-testing question; (b) fails to submit the properly executed Contest documents; and/or (c) cannot accept the applicable prize for any reason, then he/she will be disqualified (and will forfeit all rights to the prize) and an alternate winner may be selected.

Winners are responsible for obtaining professional tax advice and are responsible for any tax obligations arising from the Prizes.

Prior to being declared a confirmed winner of a Prize, the potential winner will be required to: (i) correctly answer a time-limited, mathematical, skill-testing question (without electronic, mechanical or other assistance); and (ii) sign and submit the Sponsor’s declaration and release, which (among other things): (a) confirms compliance with these Rules; (b) acknowledges acceptance of the prize as awarded; and (c) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize. If a potential winner: (a) fails to correctly answer the skill-testing question; (b) fails to submit the properly executed Contest documents; and/or (c) cannot accept the applicable prize for any reason, then he/she will be disqualified (and will forfeit all rights to the prize) and an alternate winner may be selected.

Winners are responsible for obtaining professional tax advice and are responsible for any tax obligations arising from the Prizes.

6. GENERAL:

The decisions of the Sponsor (and/or the Contest Administrator, as applicable) with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Eligible Transactions and/or entrants, and are in Québec subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”), if applicable. By participating in this Contest, you are giving consent to the Sponsor to obtain (and to deliver to the Contest Administrator) your name, address, email address and other information only for the purpose of administering this Contest. Sponsor and/or its agents or representatives may obtain personally identifiable information about you only in the event that you are a selected entrant in accordance with these Rules. The Released Parties are not responsible for: (i) any error, omission, interruption, defect or delay in transmission or communication; (ii) technical or mechanical malfunctions; (iii) errors in these Rules or in any Contest-related advertisements or other materials; and (iv) failures of electronic equipment, computer hardware or software, or inaccurate capture of information, whether caused by equipment, programming used in this Contest, human processing error, or otherwise.

Sponsor reserves the right, at its sole discretion, and in Québec subject to the approval of the Régie, where applicable, to disqualify any entry, to modify, terminate, or suspend this Contest (or amend these Rules) should a virus, bug, non-authorized human intervention, action of entrant(s), or other cause corrupt or impair the administration, security, fairness, or proper play of the Contest, and, if the Contest is modified, terminated, or suspended, to select at random a winner from those eligible, non-suspect entries received prior to the event requiring such modification, termination or suspension. The Sponsor reserves the right, and in Québec subject to the approval of the Régie, to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. 

For Québec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

By participating in this Contest, each entrant: (i) agrees to be legally bound by these Rules; (ii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action; and (iii) releases the Released Parties from any and all liability in connection with this Contest and his/her participation therein.

By participating, entrants agree that the Released Parties shall have no liability and will be held harmless for any liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a Prize or participation in this Contest.

Except where prohibited by law, acceptance of a Prize constitutes winner’s consent to Sponsor’s and its agents’ use of the winner’s name, likeness, photograph, voice, opinions and/or city/province of residence for advertising and promotional purposes in any media, worldwide, without payment or consideration. You may be required to sign a document confirming your consent to this effect. Personal information of the Prize winners may be stored on servers located in the United States and therefore subject to the laws of the U.S. and/or other jurisdictions.

All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates and/or the participating Mastercard issuing financial institutions. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to any point of sale, television, print or online advertising or the French version of these Rules; the terms and conditions of these English Rules shall prevail, govern and control.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, and the Contest Administrator storing, sharing and using the entrant’s personal information only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy https://www.mastercard.ca/en-ca/vision/corp-responsibility/commitment-to-privacy/global-privacy-policy.html unless the entrant otherwise agrees.
